FAQ
Do I need a lawyer to represent me in court?

In NSW criminal cases the law pursuant to section 37 Criminal Procedure Act 1986 states that the accused person’s case may be conducted by the accused person themselves or by their lawyer.

In deciding whether you need a lawyer to represent you, you should first assess the nature of the criminal charge(s) that you are facing, which court you are attending, the maximum penalty available in that court and what possible outcome you intend to achieve in the end.

Most lawyers will have an area of law they specialise in, for example, criminal law, family law or conveyancing.

A specialised lawyer can help you understand your legal rights, identify any defences that you may not have been aware of.

Your lawyer can also inform you of the elements associated to the charge and if the prosecution can prove its case against you and further negotiate with the prosecution to drop or downgrade charges early in the proceedings.

Importantly inform you of any time limits that may apply to your case.

We recommend that you contact our specialist criminal lawyers and utilise our free first appointment services to make an informed decision if you wish to have a lawyer represent you in court.

It is important that you know the legal costs involved in your case when dealing with a lawyer.

Lawyers charge professional costs and disbursements. Professional costs can be charged a number of difference ways such as a fixed amount or an hourly rate. Disbursements are charged for costs related to things including photocopying or any items that are paid for on your behalf such as court filing fees, barristers’ fees and or medical reports.

Lawyers will also charge for a range of legal work they do for you, including: phone calls, emails, drafting documents, spending time reviewing your case, preparing for court and attending court on your behalf.

The cost involved will depend on the type of charge, the complexity of the case and which court the matter is to be ultimately heard in.

Criminal Lawyers Sydney offers a fixed fee for certain types of cases with no hidden costs. This means that you can get the best criminal defence in Sydney at affordable prices.

Legal aid NSW provides a range of legal services to disadvantage people about legal issues affecting them.

Legal advice is not available for everyone and unable to represent everyone, but this does not mean that you have no other options. Criminal lawyers Sydney can discuss your legal problem and identify if you are eligible for our fixed fee service.

Legal aid is also not free- most people will have to pay a contribution fee, depending on their financial circumstances and the type of case and the area of law. You must meet the eligibility requirements for a grant of legal aid, including a means test.

Criminal Lawyers Sydney are on the legal aid panel for District Court trials. If you have an upcoming trial that you wish to retain a private lawyer through the grant of aid, call us now to discuss further.
